Pursuant to 11 U.S.C. § 502(b)(9), the deadline for a governmental unit to file <br /> proofs of claim is on or before January 18, 2021 ("Government Bar Date"). <br /> Important Information Regarding the Filing of a Proof of Claim <br /> Except as provide below, any person or entity (a "Creditor") who holds or asserts a claim <br /> against the Debtor that arose prior to the Debtor's bankruptcy petition filing must file a proof of <br /> claim in order to be paid on the claim. A claim is defined as a right to payment "whether or not <br /> such right is reduced to judgment, liquidated, unliquidated, fixed, contingent, matured, <br /> unmatured, disputed, undisputed, legal, equitable, secured, or unsecured" and may include a right <br /> to an equitable remedy for breach of performance if such breach gives rise to a right to payment. <br /> 11 U.S.C. § 101(5). <br /> Notwithstanding the foregoing, a Creditor is not required to file a proof of claim on or <br /> before the deadline (the General Bar Date or Government Bar Date as applicable) for the <br /> following types of claims: <br /> a. A claim for which there is already a proof of claim filed by the Creditor; <br /> b. A claim that has been allowed by an order of this Court entered on or before the <br /> applicable bar date; <br /> c. A claim arising after the petition was filed that is entitled to administrative <br /> expense status and priority in payment under 11 U.S.C. §§ 503(b) and 507(a)(2), <br /> except with respect to claims arising under section 503(b)(9) of the Bankruptcy <br /> Code which, for the avoidance of doubt, must be filed by the General Bar Date; <br /> d. A claim scheduled by the Debtor that is not listed as disputed, contingent, or <br /> unliquidated, and for which the Creditor does not dispute the amount, priority or <br /> nature of the claim as scheduled; and <br /> e. A claim for which a separate deadline is fixed by this Court. <br /> To be timely, a proof of claim must be received by the claims agent, Epiq, on or before <br /> the deadline (the General Bar Date or Government Bar Date as applicable). Each proof of claim <br /> must clearly identify the Debtor against which the claim is asserted, including the specific <br /> Debtor's case number. A proof of claim filed under the jointly administered case number (No. <br /> 20-12043) or a proof of claim that does not identify the specific Debtor will be deemed as filed <br /> only against Hopedale Mining LLC. <br /> A proof of claim may be filed by a Creditor with Epiq in one of the following manners: <br /> (i) electronically by using the File a Claim link on Epiq's website at <br /> https:Hdm.epigII.com/rhino, which is accessible through the court website at <br /> https://www.ohsb.uscourts.gov/; or(ii)by mail or hand delivery at the following addresses: <br />
