Proposed Decision <br /> The Colorado Division of Reclamation,Mining and Safety Proposes to APPROVE the Application <br /> for Permit Revision No 10(PRIO). <br /> The application was submitted by Trapper Mining, Inc. This decision is based on a finding that the <br /> operations comply with all requirements of the Colorado State Program as found in the Colorado <br /> Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated <br /> pursuant to the Act. If no request for a formal hearing is made within thirty (30)days of the first <br /> publication of the issuance of this proposed decision,then this decision becomes final. The permit <br /> revision will be finalized upon submittal to DRMS of acceptable surety by the applicant if necessary. <br /> The permit application,all supporting documentation and any stipulations or conditions become a <br /> binding part of the permit. <br /> No coal mining operations may be conducted on any Federal surface or coal until the Assistant <br /> Secretary for Lands and Minerals Management with the U.S. Department of the Interior has <br /> approved any required federal mining plan or modification thereof. <br /> This proposed decision proposes the addition of 155.0 new acres or disturbance for PR10, as well as <br /> the following: <br /> o An additional re-disturbance of 51.7 acres of Phase III bond released areas all amendments to <br /> PR10 for a total disturbed acreage of 206.7 acres. <br /> Mining will continue in L and N pits and I and J pits will be reopened. Reclamation will continue in <br /> Kimber(K), Lancaster(L),Ashmore (A), and Darringer(D), Pits. <br /> Previously approved under Permit Revision No. 7 (PR7), Trapper proposed no new disturbance <br /> within the 795.72-acre PR7 permit expansion area at the time (2015). Baseline information required <br /> by the regulations for future areas of mining was not submitted with PR7. The following Stipulation <br /> 922 was therefore attached to TMI's permit and was put into effect for the PR7 permit expansion <br /> area. The items comprising the stipulation were incorporated into Permit Revision No. 9 (PR9) as <br /> was the construction of new ponds located in the Deal, Deacon and Jeffway drainages and associated <br /> with Stipulation 21. Stipulation No. 22 states: <br /> Stipulation No. 22: <br /> Prior to disturbance within the 795.72-acre PR7 permit expansion area, the permittee must <br /> submit and receive approval of an application for a permit revision that contains the following <br /> required information for this area: <br /> a. A narrative of the land capability and productivity before any mining in <br /> accordance with Rule 2.04.3(2)(b). <br /> b. Cultural and historic resource information for areas proposed or likely to be <br /> affected by surface mining activities in accordance with Rule 2.04.4. <br /> 2 <br />
