Holliday <br /> Colorado Quarry I, LLC <br /> 901 S County Road 31 <br /> Berthoud, CO 80513 <br /> RE: Reason to Believe a Violation Exists and 'notice of Board Hearing <br /> Meadow Hollow Quarry; Permit No. M-2009-006 <br /> Dear Mr. Holliday: <br /> On April 9, 2020, the Division of Reclamation, Mining and Safety(Division) sent Colorado Quarry I, LLC a <br /> notice of financial warranty increase(SI-0I)-The required financial warranty for Meadow Hollow Quarry was <br /> increased to $29,723.00, which is an increase of $13,723.00 from the currently held financial warranty of <br /> $16,000.00. The additional required financial warranty was originally due on June 8, 2020. The Division <br /> granted two extensions to the due date, with the most recent deadline being set for September 7, 2020. As of <br /> the date of this letter, the Division has not received the required financial warranty increase. <br /> The Division believes this is a violation of <br /> ■ C.R.S. 34-32.5-11-(4)(c)(I1) and Rule 4.2.1(2) for failure to post the additional required financial <br /> warranty within sixty(60) days of the date of notice of the adjustment. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation Act for <br /> the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et sea., and the provisions of your Permit No. <br /> M-2009-006, and has scheduled this matter to appear before the Mined Land Reclamation Board (Board). <br /> A Formal Public.Hearing will be held during the November M-19, 2020 Board meeting for consideration of, <br /> the possible violation, corrective actions, permit revocation, and finding the financial warranty subject to <br /> forfeiture. Due to the impacts of the COVID-19 pandernic on the availability of State facilities and Division <br /> resources, notice is hereby given that the this Board hearing will be held by a virtual ZOOM hearing. All <br /> exhibits and materials you wish for the Board to consider related to this alleged violation must be submitted <br /> via email to the Board administrator, Camie Mojar at Camille.Moiar,cr::state.co.us no later than 5:00 p.m. on <br /> November 6, 2020.
