Peabodq <br />Hayden Gulch Terminal, LLC <br />29515 Routt County Road 27 <br />Oak Creek, CO 80467 <br />970.879.3800 <br />Ms. Tabetha Lynch September 22, 2020 <br />Colorado Division of Reclamation, Mining, and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />(303) 866-3567 Ext, 8147 <br />RE: Hayden Gulch Terminal, LLC -Hayden Gulch Loadout (C-1992-081), Permit Revision <br />(PR20-02) for a Change in the Postmining Land Use <br />Dear Ms. Lynch: <br />Hayden Gulch Terminal, LLC (HGT) respectfully requests CDRMS approval of a Permit Revision to our <br />existing approved Permit, to modify our approved reclamation plan and postmining land use for the <br />major portion of the Hayden Gulch Loadout, consistent with the transfer of former rail spur areas to the <br />Town of Hayden (Hayden) for recreational use. Under the attached "Land Exchange Letter of Intent" <br />from the Town of Hayden, the former rail spur area will be converted to a recreational trail for the use <br />of residents and visitors to Hayden under a locally managed "Tracks -to -Trails" program. <br />Coal was handled and shipped from this facility through 1987, and the last active use of the facility <br />was for temporary coal storage in 1992. The loadout facilities were removed, and the associated <br />disturbance areas reclaimed in 2011 — 2012, and beginning in 2016 through 2019, the railroad spur <br />track, ties, and ballast were removed and a parking area for the future trail was constructed. <br />This submittal includes revised PAP text and supporting materials, as identified by the attached <br />Summary of Revisions/Additions. With the requested change in postmining land use, HDT <br />subsequently plans to submit a bond release application for the subject area used for recreation. We <br />recognize that this will necessarily be a phased process, with the change in postmining land use <br />occurring first, then the bond release, and finally, the reduction in permit area. We appreciate your <br />consideration, cooperation, and assistance in facilitating timely review and approval of this revision <br />application and look forward to working with you to facilitate this process.
