COLORADO <br /> Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Rr: <br /> September 23, 2020 <br /> Ralph Bell <br /> Castle Rock Construction Company of Colorado, LLC <br /> 6374 S Racine Circle <br /> Centennial, CO 80111 <br /> Re: Reason to Believe a Violation Exists and Notice of Board Hearing <br /> Strode Pit,Permit M-2019-002 <br /> Mr. Bell: <br /> On September 4, 2020,the Division of Reclamation, Mining and Safety(Division)conducted an <br /> inspection of the Strode Pit(Permit M-2019-002) and found wash water and fines from the process <br /> sediment pond were released off-site into an unnamed drainage which reports to the South Fork of the <br /> Republican River, affecting an estimated 0.34 acres of land outside of the permit boundary.The Division <br /> also found the Operator had affected approximately 1.51 acres of additional off-site land by placing <br /> topsoil and overburden outside of the permit boundary. Based on the findings of the inspection we believe <br /> this is a violation of <br /> • C.R.S. 34-32.5-116(4)(h) for failure to minimize disturbances to the prevailing hydrologic <br /> balance of the affected land and of the surrounding area and to the quality and quantity of water <br /> in surface and groundwater systems both during and after the mining operation and during <br /> reclamation. <br /> • C.R.S. 34-32.5-121 for failure to notify the Division of a failure or imminent failure, as soon as <br /> reasonably practicable after such person has knowledge of such condition or of any <br /> impoundment, embankment, or slope that poses a reasonable potential for danger to any persons <br /> or property. <br /> • C.R.S. 34-32.5-116(4)(i) for failure to protect areas outside of the affected land from slides or <br /> damages occurring during the mining operation and reclamation. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation Act <br /> for the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et sM.,and have scheduled this matter <br /> to appear before the Mined Land Reclamation Board. <br /> A Formal Public Hearing will be held during the November 18-19, 2020 Board meeting for <br /> consideration of the possible violation and corrective actions. Due to the impacts of the COVID-19 <br /> virus on the availability of State facilities and Division resources, notice is hereby given that the <br /> November 18-19, 2020 Board hearing will be held by a virtual ZOOM hearing. All exhibits and <br /> materials you wish for the Board to consider related to this alleged violation must be submitted via <br /> email to the Board administrator, Camie Mojar at Caniille.Mojar a state: co.us no later than 5:00 p.m. <br /> on November 6, 2020.
