Lessee shall have quiet enjoyment of the leased premises throughout the term of this <br /> Lease and any extension or renewal hereof. <br /> 22. Tide to Leased Premises. <br /> (a) Lessee, at its sole expense, shall have the right at any time <br /> during the term of this Lease to examine title to the Leased Premises, and Lessor shall <br /> furnish to Lessee all abstracts and other title information covering the Leased Premises <br /> which Lessor has in his possession or under his control. If objections to Lessor's title be <br /> found, Lessee shall specify such objections in writing and deliver the same to Lessor. <br /> Lessor shall have all title objections, so specified by Lessee, corrected to the satisfaction <br /> of Lessee within sixty (60) days after the date of delivery of said written objections. <br /> Default on the part of Lessor to cure any objections to title, as herein provided,shall give <br /> to Lessee the option of terminating this Lease on notice to Lessor, or of curing and <br /> correcting such objections. If Lessee cures or corrects such objection, Lessor agrees to <br /> pay the costs of curing and correcting such objections, including any cure amount, <br /> attorney fees,court costs,abstracting and other expenses associated therewith. <br /> (b) In the event Lessor is the owner of an interest in the coal less <br /> than the entire fee interest therein, Lessor agrees that it will, upon written demand by <br /> Lessee and to the extent possible under state law, commence appropriate action in a court <br /> of competent jurisdiction against the owners of the undivided interest in the coal to <br /> compel partition of the coal. Lessee will cooperate with Lessor in such action as to <br /> selection of counsel and will be available at reasonable times for consultations, <br /> appearance for depositions, appearance in court and other as may be necessary or <br /> (L0406980.10) 1'� <br />
