through the Leased Premises, then this Lease shall be automatically extended upon the <br /> same terms and conditions for successive one (1)year period(s) until Lessee is no longer <br /> exercising wheelage rights over or through the Leased Premises, to the extent necessary <br /> to permit such use, unless otherwise terminated as hereinafter provided. No written <br /> notice of such extension(s) shall be required of Lessee. <br /> (b) If prior to the end of the Initial Term all of the mineable and i <br /> merchantable coal in the Leased Premises shall not have been mined and removed by <br /> Lessee, Lessee, at its option, may extend this Lease for up to five (5) additional periods <br /> of five (5) years each, upon sixty (60) days' written notice prior to the end of the Initial <br /> Term or any additional period. As used herein "mineable and merchantable coal"means <br /> coal which can be mined and marketed at a reasonable profit to Lessee at the time such <br /> coal is reached in the course of Lessee's mining operations by the use of practical and <br /> sufficient machinery, facilities,methods and management. <br /> 3. Entry after Termination. After expiration or termination of this <br /> Lease for any reason, Lessee shall have the right to enter upon the Leased Premises, <br /> without rental, (a) for a period of six (6) months for the purpose of removing all of <br /> Lessee's buildings, structures, machinery, equipment and other property from any part of <br /> the Leased Premises, that were constructed by Lessee or are otherwise Lessee's property <br /> and (b) until full bond release is achieved for the purpose of reclaiming areas disturbed <br /> by its mining and otherwise complying with the requirements of any federal, state and <br /> local law,rule,regulation or ordinance. <br /> I <br /> SL0406980.10) <br /> 2 <br /> I <br />
