Compliance With Mine Plan N - Support Facilities Not On-site <br />N - Other N - Special Categories Of Mining <br />N - Processing Waste Y - Topsoil <br /> <br /> <br />COMMENTS <br /> <br />A partial inspection was conducted by Daniel Cunningham of DRMS on September 10, 2020. Nick Mason of New <br />Elk Coal Companu, LLC (NECC) was present for the inspection. <br />EXCESS SPOIL and DEVELOPMENT WASTE Rule 4.09 <br />Placement; Drainage Control; Surface Stabilization: <br />Containment Area 3, 4, and 5 were inspected. No issues were noted. <br /> <br />The reclaimed Developmental Waste Pile was inspected. Good vegetation was noted throughout and no issues <br />were seen. <br /> <br />The Developmental Waste #2 (DWDA) was inspected. No major issues were noted. A small amount of wastehad <br />been moved from the DWDA #2 to the RDA. <br /> <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Pond 004A was inspected. Pond 004 did have standing water in that was pumped to it from pond 008A due to a <br />recent storm. No issues were noted with embankments or spillways. <br /> <br />Culverts 6, 13, 14, 29, 30, 37, and 60 were inspected. No issues were noted. <br /> <br />Ditches 2, 3, 4, 10, 10a 11, 12, 13, 14, and 19 were inspected.
