BROMLEY LAKES-PERMANENT MAN-MADE STRUCTURES <br /> The purpose of this Exhibit is to specifically identify permanent man-made structures <br /> within 200 ft. of the historic permit(property)boundary and address any issues relative to <br /> their protection and/or relocation as a result of proposed amended mining and <br /> reclamation activities. The following manmade structures are, thus, identified below: <br /> ■ Various residential and commercial structures were originally identified within <br /> 200 ft. of the Bromley Lakes permit boundary.All of these structures are at least <br /> 50 ft from the permit boundary and at least 75 to 100 ft from proposed mining <br /> limits and their stability will not be affected by mining as discussed further below <br /> in the Geotechnical Stability Exhibit. Owners of these structures were notified by <br /> mailings about the proposed affected land following submittal of this application <br /> per Colorado Mined Land Board rules. <br /> ■ Third Creek runs along the northeast side of the new expansion area and falls <br /> within 200 ft of the proposed mining operation. The mining plan includes a <br /> minimum 50 ft geotechnical setback from the creek where it runs through the <br /> property that will protect the stability of the creek. <br /> ■ The McCanne Ditch currently runs through the property,but will be relocated <br /> under a Nationwide (46)404 Permit from USACE.A new easement for the ditch <br /> will be established when it is relocated. Ready Mixed has permission from the <br /> McCanne Ditch Company to relocate the ditch and to mine within 50 ft of either <br /> side of its existing or new location.A Carriage Agreement between the Ditch <br /> Company and Ready Mixed Concrete Company to that effect is included in this <br /> Exhibit. <br /> ■ Spier Single Family Residence is of particular emphasis because it will be <br /> surrounded by active mining. The closest structure on this property is at least 50 <br /> ft from the permit boundary. With the minimum 25 ft mining setbacks proposed <br /> in this area, no structure will be within 75 ft of the boundary. General global <br /> ■ Stability analyses previously performed in the vicinity show mining within 35 ft <br /> of the boundary is stable with a reasonable Safety Factor as discussed further in <br /> the Geotechnical Stability Exhibit. <br /> 8/16/2020 <br />
