BEFORE THE MINED LAND RECLAMATION BOARD STATE OF COLORADO Notice of Violation No. MV-2019-034 FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER THE FORFEITURE OF THE FINANCIAL WARRANTY OF JUBILEE VENTURE, INC., File No. M-2011-029 THIS MATTER came before the Mined Land Reclamation Board ("Board") on June 24, 2020 in Denver, Colorado and via videoconference to consider the forfeiture of financial warranty of Jubilee Venture, Inc. ("Operator"), file number M-2011-029. There were no appearances on behalf of the Operator. Clayton Wein appeared on behalf of the Division of Reclamation, Mining and Safety ("Divisions'}. The Board, having considered the materials presented and having been otherwise fully informed of the facts in the matter, enters the following: FINDINGS OF FACT 1. The Operator holds a 112 permit for a 13.5-acre gold mining operation. The site, known as the Eagle Mine, is located in Section 2, Township 10 North, Range 92 West, 6th Principal Meridian, in Moffat County. 2. Operator's annual report, map, and fee were due on August 16, 2019. The Division never received a submittal by Operator. 3. On August 28, 2019, the Division mailed the Operator a Reason to Believe a Violation Exists letter stating alleged violations for failure to submit the required annual report, map, and fee, 4. The Division holds a financial warranty for the permit in the amount of$53,620. 5. Through an order effective December 19, 2019, the Board ordered Operator's permit M-2011-029 revoked and found that Operator's failure to cure a default of its performance warranty rendered the financial warranty subject to forfeiture. 6. On April 23, 2020, the Division mailed Operator notice that the financial warranty was subject to forfeiture and that a hearing would be held at the Board's June 24, 2020 meeting to consider final forfeiture.
