BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Notice of Violation No. MV-2019-034 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> THE FORFEITURE OF THE FINANCIAL WARRANTY OF JUBILEE VENTURE, <br /> INC., File No. M-2011-029 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> June 24, 2020 in Denver, Colorado and via videoconference to consider the forfeiture <br /> of financial warranty of Jubilee Venture, Inc. ("Operator"), file number M-2011-029. <br /> There were no appearances on behalf of the Operator. Clayton Wein appeared on <br /> behalf of the Division of Reclamation, Mining and Safety ("Divisions'}. <br /> The Board, having considered the materials presented and having been <br /> otherwise fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. The Operator holds a 112 permit for a 13.5-acre gold mining operation. <br /> The site, known as the Eagle Mine, is located in Section 2, Township 10 North, <br /> Range 92 West, 6th Principal Meridian, in Moffat County. <br /> 2. Operator's annual report, map, and fee were due on August 16, 2019. <br /> The Division never received a submittal by Operator. <br /> 3. On August 28, 2019, the Division mailed the Operator a Reason to <br /> Believe a Violation Exists letter stating alleged violations for failure to submit the <br /> required annual report, map, and fee, <br /> 4. The Division holds a financial warranty for the permit in the amount <br /> of$53,620. <br /> 5. Through an order effective December 19, 2019, the Board ordered <br /> Operator's permit M-2011-029 revoked and found that Operator's failure to cure a <br /> default of its performance warranty rendered the financial warranty subject to <br /> forfeiture. <br /> 6. On April 23, 2020, the Division mailed Operator notice that the <br /> financial warranty was subject to forfeiture and that a hearing would be held at the <br /> Board's June 24, 2020 meeting to consider final forfeiture. <br />
