M-2008-017—Broken Arrow Investments,LLC—Derr Pit—Technical Revision Request No.
August 25,2020
-2-
MW-8, MW-14, MW-15, MW-16, MW-17, and MW-18. Please see the attached location map for
reference.
2. The off-site wells that are currently being monitored are the as follows:
a. Hoffner#1 Dom and Hoffner#2 Irr owned by Dixie Ann Hoffner and Jerry Winters.
b. Koehler #1 Dom, Koehler #2 Stock, and Koehler #3 Irr owned by Mr. Jim Koehler
(James R. Koehler Revocable Trust).
c. Global Assets Davis Well owned by Global Asset Recovery, LLC.
d. Bliss Irr owned by David Bliss.
e. Parker Dom owned by Silvia Parker.
f. Francis#1 Stock, Francis#2 Irr, and Francis#3 Dom owned by Rocky Francis.
g. Taylor Dom owned by Dianna Taylor.
h. Harrell#1 Dom and Harrell #2 Irr owned by Brian Harrell.
i. Murata #1 Irr owned by Brian Murata.
During the months of June and July AgPro had some difficulty in getting readings/measurements on the
Francis#2 Irr, Hoffner#2 Irr, and Bliss Irr wells. The difficulty was due to not having access in the case
of the Francis#2 Irr well in June as there was maintenance being performed by a contractor at the time
of measurement; difficulty in July at the Hoffner#2 Irr and Bliss Irr being the pumps were running so a
level probe could not be placed down the well and also the reading would be erroneous showing
drawdown rather than the static water level.
The first part of August AgPro sent out letters to each land/well owner stating that the normal monthly
readings/measurements would be taken on the 2"d Thursday of every month between 8:00 AM and
2:00 PM and asked that someone be available to shut off any pumps so that the
readings/measurements could be taken. After the notifications went out prior to sampling in August
AgPro had the same issues with the Hoffner #2 Irr and Bliss Irr wells not being shut down to take
readings/measurements. AgPro contacted the tenant farmer for both wells (Mr. Giesick) and he
indicated he would not be shutting them down for some time. AgPro asked when for each well and Mr.
Giesick indicated this week for Hoffner #2 Irr and not until sometime in September for the Bliss Irr.
AgPro went to the Hoffner#2 Irr this week and it was still running so they could not get a reading.
Broken Arrow Investments, LLC would like to revise the monitoring plan to reflect that some of the wells
may not be able to be measured monthly as the tenant farmer/owner will not shut down the wells to
allow for measurements. We believe that AgPro has provided sufficient notice and picked a day every
month where they can take measurements for monitoring but they are not getting cooperation from
some of the tenant farmers and well owners. We would request that if access is denied or if pumps are
not being shut down for AgPro to measure the well levels monthly based on the schedule for monitoring
that was provided to each land/well owner that monitoring is not required for that month.
Broken Arrow Investments, LLC appreciates your consideration of this revision request and looks
forward to your response.
4 I 305 Denver Avenue—Suite D•Fort Lupton CO 80621 •Ph: 303-857-6222•Fax:303-857-6224
