<br />Mountain Coal Company, LLC (MCC), Permit No. C-1980-007, is submitting this
<br />application for Phase II performance bond release for the West Elk Mine. MCC is
<br />requesting that a total of approximately 41.6 acres be Phase II released with this
<br />application. With this application, the West Elk Mine will be requesting relinquishment
<br />of 15% of the base bond held for these parcels.

<br />A. General Location Description
<br />The Phase II Bond Release Block covers approximately 41.6 acres of private and
<br />National Forest System lands specifically located within portions of Sections 14, 23, 27,
<br />33, 34, 35 and 36, Township 13 South, Range 90 West, and Sections 1, 2 and 3,
<br />Township 14 South, Range 90 West. Please refer to Map 1 for the exact locations.
<br />B. Public Notice
<br />Mountain Coal Company, LLC (MCC), 5174 Highway 133, Somerset, CO 81434, (970)
<br />929-5015, has filed a Phase II Bond Release Request Application to MCC's Mining and
<br />Reclamation Permit No. C-1980-007 with the Colorado Mined Land Reclamation Board),
<br />under the provisions of the Colorado Surface Coal Mining Reclamation Act of 1979.
<br />MCC's mining and reclamation permit was originally issued in July 1981, and
<br />subsequently renewed in August1986, January 1993 (effective August 1991), July 1996,
<br />July 2001, April 2007 (effective July 2006), and November 2011 (effective July 2011.)
<br />MCC is currently undergoing a five-year permit renewal process that would extend the
<br />permit term to July 31, 2021. MCC's five-year permit area contains lands in Sections 9-
<br />11, and 13- 36, TUS, R90W, 6th PM; Sections 23- 26, TOS, R91W, 6th PM, and
<br />Sections 1- 5, 8- 12, 14- 16 and 21- 23, T14S, R90W, 6th PM in Delta and Gunnison
