2.03.8 Permit Term Information <br /> (1) Surface mining activities (open pit or strip mining) are not planned within the <br /> permit area. <br /> (2) The construction of the surface facilities will be delayed until the coal market <br /> improves. Approximately 38.1 acres will be affected and disturbed during the <br /> life of the operation. Since no underground mining will take place, affected <br /> and disturbed acreage will be the same. <br /> (3) The Applicant will conduct loadout operations in excess of 5 years. The <br /> applicant requests a permit term of five years. <br /> Rule 2.05.1(2) states: A permit shall terminate if the permittee has not commenced the <br /> surface coal mining and reclamation operations covered by the permit within three years of <br /> the date of the issuance of the permit. Due to numerous reasons, included the soft coal <br /> market, construction of the loadout has not commenced. DRMS Rule 2.01.5 allows the <br /> Division or Board to grant reasonable extensions of time for commencement of these <br /> operations. The Division has granted three extensions as outlined below. <br /> The first permit issued by DRMS for the Fruita loadout was for a permit term from March 6, <br /> 2012—March 6, 2017. The succeeding three-year commencement periods are as follows: <br /> First: From March 6, 2012 - March 6, 2015. <br /> Second: From March 6, 2015 - March 6, 2018. <br /> Third: From March 6, 2018 - March 6, 2021. <br /> MR-08 2.03-8 03/19 <br />
