The Division's review comprised numerous rules with adequacy questions
for Rule 3.03.1(3)b).
Rule 3.031(3)b): Release of Performance Bonds
DRMS August 2020
For phase II bond release sediment loading must be analyzed in order to demonstrate the
contribution of suspended solids to streamflow or runoff outside the permit boundary. DRMS is
unable to verify the contributions of suspended solids to streamflow or runoff as no TSS data
was included in the application. This information is generally submitted with the phase II
application. In previous phase II applications for Seneca IIW, DRMS has requested that this
information be provided. The Division requests the following information:
TSS data for ponds
2. An analysis using a predictive model, such as SEDCAD or RUSLE, comparing
suspended solids generated from pre mining lad or comparable adjacent areas to the bond
release area.
3. Any text and tables regarding a phase II sedimentology and hydrology and water quality
supporting information
4. TSS data for outfalls.
Two items require correction in the SL6 application as follows:
DRMS notes that Table 1, Table 2, Table 3 in the SL6 application reference Bond
Release Block 3 (BRB-3), yet within the tables, they reference bond release block 1
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
Jared S.
