Savage and Savage Environmental <br />practical solutions for environmental issues <br />4610 Haystack Drive 970 674 8080 telephone <br />Windsor, Colorado 80550 970 674 8088 facsimile <br />savageandsavage@earthlink.net <br />August 7, 2020 <br />Delta County Commissioners <br />Delta County Courthouse <br />501 Palmer St., #211 <br />Delta, Colorado 81416 <br />Re: Bond Release Application (SL -03), Oxbow Mining LLC, Elk Creek Mine, <br />(CDRMS file C-1981-022) <br />Dear Delta County Commissioners: <br />Oxbow Mining, LLC (OMLLC) is applying for Phase H liability and reclamation bond <br />release for portions of the Ell{ Creek Mine (Colorado Division of Reclamation, Mining, <br />and Safety permit C-1981-022) in accordance with the approved reclamation plan. The <br />subject of the bond release is a release from liability and reclamation bond for areas where <br />it has been demonstrated that OMLLC has successfully established vegetation supporting <br />the post -mining land use, meeting the approved success standard for cover, and <br />demonstrating that suspended solids contributions to runoff or streamflow outside the <br />permit area do not exceed pre -mining levels at reclaimed areas within the mine site (Phase <br />II). <br />The reclaimed areas requesting bond release are located in portions of Sections 27-34, T12S, <br />R90W, Sections 25-27 and 34-36, T12S, R91 W, Sections 6 and 7, T13S, R89W, Sections 1-12 <br />and 17, T13S, R90W, Sections 1-3 and 11-13,T3 S, R91W, all within the 6t" PM, Delta and <br />Gunnison Counties, Colorado. The mine permit area entrance is located north of Somerset, <br />Colorado, and is accessed from Colorado Highway 133. <br />As required by Colorado law, whenever bond release is requested, all interested or affected <br />parties with a valid legal interest must be notified and afforded the opportunity to comment <br />or request an informal conference on the bond release in accordance with Rule 3.03.3 of <br />the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />
