Salisbury Gladstone LLC <br /> 15954 Jackson Ck Pkwy B281 <br /> Monument Co 80132 <br /> DECEIVED <br /> i�u + B 2020 <br /> August 14,2020 i,ECLA010M <br /> .rdl+rlC� <br /> MINING AND SAFETY <br /> Mr. Peter Hayes <br /> Re: File#M-2020-030 <br /> Salisbury Gladstone LLC strongly disagrees with the DRMS determination that a DMO application is needed for the <br /> Gladstone site.There-for per rule 7.2.4,please consider this letter as written Notification of Appeal. <br /> Salisbury Gladstone LLC believes the Limited Impact I I0(1) is the correct application Pursuant to Rule 36 of the Hard Rock <br /> Rules <br /> The DMO(112d)permit application as requested by the Colorado DRMS states that the permit is for a site of 10 acres or <br /> more, our Limited Impact I I0(l)permit application is for only 4 Acres. <br /> The requirement of Section 34-32-103(3.5)do not apply to the current I I0(1)Limited Impact operation that has been in <br /> process since there are no underground Mining activities talking place.The current 110(1)application clearly illustrates the <br /> intended use is NOT mining but processing of existing waste rock dumps. <br /> Furthermore 34-32-103(3.5)a,states that a Designated Mining Operation is in which(I)Toxic or acidic chemicals used in <br /> extractive metallurgical processing are present on site.(11)Acid or toxic forming materials will be exposed or disturbed as a <br /> result of mining operations. Page 4.14 of the current application clearly states no chemicals will be used in the milling <br /> process, Pages 5&6 indicate no water will be discharged and all refining will be done off-site. <br /> The current 110(1)Limited Impact application Pages 5&6 clearly identify the intent as a Closed Circuit Mill. Page 30 <br /> indicates the existing waste rock piles to be processed. <br /> Lastly,the Environmental Protection Specialist we have been working with, Peter Hayes has had 2 onsite meetings at the <br /> Gladstone site has been advising us on which application and exhibits needed to be included in the application.(See exhibit <br /> A attached) <br /> Going Forward,Salisbury Gladstone LLC expects the DRMS to issue a Mining Permit to Salisbury Gladstone LLC on <br /> September 3 as referenced in the August 3,2020 letter from Peter Hayes. <br /> Sincerely <br /> Je A Carter <br />
