Please see the attached inspection report. The Division's inspection revealed mining <br /> activities have occurred at the site prior to the Division issuing a reclamation permit. Based on the findings of <br /> the inspection,the Division believes this is a violation of: <br /> • C.R.S.34-32-109(2)for failure to first obtain a reclamation permit prior to engaging in a new operation. <br /> Therefore,the Division has reason to believe a violation exists to the Mined Land Reclamation Act, C.R.S. 34- <br /> 32-101 et seq., and have scheduled this matter to appear before the Mined Land Reclamation Board. <br /> Under the authority vested in the Division by C.R.S. 34-32-123(1),you are hereby ordered to immediately <br /> cease and desist all mining,prospecting,and exploration activities other than those required to prevent <br /> damage to off-site areas or protect the public health and safety. <br /> A Formal Public Hearing will be held during September 23-24, 2020 Board Meeting for consideration of the <br /> possible violation. Due to the impacts of the COVID-19 virus on availability of State facilities and Division <br /> resources, notice is hereby given the September 23-24, 2020 Mined Land Reclamation Board(MLRB) hearing <br /> will be by a virtual ZOOM hearing. <br /> All exhibits and materials you wish for the board to consider must be submitted by September 11,2020 via <br /> email to the MLRB Administrator.You must also provide an email of all parties to the MLRB Administrator, <br /> Camie Mojar,via phone at 303-866-3567, ext 8136 or via email at: Camille.moiar@state.co.us, no later than <br /> 5:00 PM, September 11, 2020 in order to receive an authorization code to attend or to request a continuance <br /> of the matter. Please note that only Parties and those who will be testifying may attend by ZOOM.
