Mr. Frank Ferris and Ms. Mindy Sickels <br />represented the operator and accompanied the inspection. Covid-19 protocols were followed. The weather was <br />clear, but the area had received an intense rain storm the preceding night. <br />ERMR provided results of the Johnson Rain gauge. 0.41 inches of rain were recorded on 7/27/2020, and an <br />additional 0.11 inches were measured in the early hours of 7/28/2020. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The mine records were verified at the New Horizon office. The operator located records that were not <br />readily found in the inspection records notebooks, and provided them during the inspection. Records were found <br />to be complete and up to date. The Availability of Records form accompanies this report. <br />BACKFILL and GRADING — Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Stabilization of Rills and Gullies <br />4.14.6: <br />The low areas in the Irrigated cropland field as a result of differential settling have been leveled in <br />accordance with the plan and in consultation with the farmer. The field has a planned swale to assist drainage of <br />runoff and minimize ponding. The mine site experienced a high intensity rainstorm the night preceding the <br />inspection. Since the field was recently replanted with the rotation seed mix, little vegetative cover was re- <br />established at the time of the storm. <br />The operator stated that they will work with the farmer to mitigate the effects of the storm on this irrigated <br />cropland field. <br />FISH and WILDLIFE — Rule 4.18: <br />A mule deer buck was hanging out at the facilities area in the afternoon.
