Woodmen Rd <br /> Falcon, CO Aurora, CO 80831-8127 <br /> Dear Mr. Waldner, <br /> This letter is being delivered to you per Construction Materials Rule 6.4.19 Exhibit S <br /> (a.) of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for <br /> the Extraction of Construction Materials. Washington County will be extracting gravel from <br /> the Nelson property located off of Washington County Road H and County Road 3. The gravel <br /> pit is located on the South East Quarter if Section 18 Township 5 South, Range 55 West. <br /> Mountain View Electric maintains poles and power lines located on County Road 3. <br /> Washington County will be extracting gravel within two hundred (200) feet of this area. <br /> Washington County will repair any damage to the poles or power lines in this area should any <br /> damage occur during the extraction process. <br /> This letter constitutes the entire understanding between the parties with respect to the <br /> subject matter contained herein and supersedes any verbal understandings and prior agreements <br /> between the parties hereto. No alterations, modifications, or revisions to this agreement shall <br /> be binding on either party unless in writing and signed by both parties. <br /> This agreement shall be interpreted and construed in accordance with the laws of the <br /> State of Colorado. <br /> Please sign both copies. One copy will be for your records. Please return the second <br /> notarized copy of this letter via the prepaid envelope to signify your understanding of <br /> Washington County's limited liability at your earliest convenience. <br />
