On the Petition Date, the Debtors filed an application (the "Section 156(c) <br /> Application") for an order appointing Epiq as claims and noticing agent pursuant to 28 U.S.C. <br /> § 156(c), section 105(a) of the Bankruptcy Code and Local Rule 2002-1(f), which was approved <br /> by this Court on July 24, 2020. The Debtors believe that administration of these chapter 11 cases <br /> will require Epiq to perform duties outside the scope of services covered by the Section 156(c) <br /> Application. Accordingly, the Debtors submit this Application to enable Epiq to provide services <br /> under the Engagement Agreement that are outside the scope of the services authorized to be <br /> provided to the Debtors by Epiq pursuant to the order approving the Section 156(c) Application. <br /> 3. In support of this Application, the Debtors submit the Declaration of Brian Hunt, <br /> Consulting Director of Epiq, in support of Epiq's retention as Administrative Advisor to the <br /> Debtors (the "Hunt Declaration"), attached hereto as Exhibit B. <br /> 4. A proposed form of order granting the relief requested in this Application is <br /> attached hereto as Exhibit C (the"Proposed Order"). <br /> Jurisdiction <br /> 5. The Court has jurisdiction to consider this matter pursuant to 28 U.S.C. §§ 157 and <br /> 1334. This is a core proceeding pursuant to 28 U.S.C. § 157(b). Venue is proper before the Court <br /> pursuant to 28 U.S.C. §§ 1408 and 1409. <br /> Background <br /> 6. The Debtors commenced chapter 11 cases under which they are seeking joint <br /> administration (the "Chapter 11 Cases") by filing voluntary petitions for relief under chapter 11 <br /> of the Bankruptcy Code on July 22, 2020 (the"Petition Date"). Pursuant to sections I I07(a) and <br /> 1108 of the Bankruptcy Code,the Debtors are operating their businesses and managing their affairs <br /> as debtors-in-possession. <br />
