1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />July 22, 2020 <br />Re: Coal Permit C-1981-41 Snowcap Coal Company, Inc.- <br />Colorado/Fontanari Request for Review to State Response of July 13, <br />2020 to Fontanari Letter and Document Packet of June 24, 2020 <br />Dear Mr. Secretary, Ladies and Gentlemen: <br />On June 24, 2020, Rudolph Fontanari made an extensive request for, <br />inter alia, an inspection of the Snowcap permit area to address a list <br />of concerns detailed in the June 24 letter and extensive attachments. <br />Fontanari incorporates his letter and attachments by reference. The <br />initial federal copies of the letter went to the Secretary and to the <br />OSM office at 1999 Broadway in Denver. We have been directed to <br />Mr. Mckinnon; if he has not obtained a copy of the original Fontanari <br />submittal we will gladly provide one. <br />On July 13, the Colorado's Coal Program director denied the request <br />by letter (Attached hereto as Exhibit A). We do request a review by <br />the administrator, and further request that the Office of Surface <br />Mining indicate in writing whether it is deferring entirely to the State <br />in making this determination. Our letter was not directed solely at <br />potential "violations", but also the manner in which reclamation at <br />Page 02 <br />
