COLORADO <br /> Division of Reclamation, <br /> ' Mining and Safety <br /> Department of Natural Resources <br /> 1313 Sherman St. Room 215 <br /> Denver, CO 80203 <br /> July 20, 2020 <br /> Mr. Cliff Simpson <br /> C&H Aggregate LLC <br /> PO Box 211 <br /> Nunn CO 80648 <br /> RE: Lone Tree Pit,Permit M2010-047 <br /> Status of Incomplete Application for Transfer of Permit and Succession of Operators-SO01 <br /> Mr. Simpson, <br /> On July 10, 2020 the Division of Reclamation, Mining and Safety received the Application Form for Transfer of Mineral <br /> Permit and Succession of Operators from Miller Family Investments,LLC to C&H Aggregate LLC. of permit M2010-047. <br /> At this time,the Succession of Operators application as submitted has been deemed incomplete by the Division. <br /> The following item(s)have been submitted to the Division and are acceptable at this time: <br /> 1) Executed Performance Warranty Form <br /> 2) Succession of Operators Application fee of$144. <br /> The followin item(s)tem(s)are still required for your Succession of Operators application to be called complete: <br /> 1) Properly executed Application Form specifying the Designation of Review Timeline. This section, and the <br /> appropriate review timeline selection, needs to be properly executed by both the Current Permittee (Miller) and <br /> Prospective Successor(C&H Aggregate). <br /> 2) Demonstration of Legal Right to Enter the property for the purposes of mining and reclamation in accordance with <br /> Construction Materials Rules. To comply with this requirement, the Prospective Successor must demonstrate that <br /> he/she has obtained a legal right of entry from any and all surface and mineral rights owners in the affected lands, <br /> independent of the current Permittee. See Construction Materials Rules 6.3.7, 6.4.14, and 1 .6.2(l)(e)(i). This may <br /> be a copy of an access lease, deed, abstract of title, current tax receipt, or a signed and notarized statement by the <br /> property owners stating that the Prospective Successor has a legal right to enter. <br /> 3) Structure Agreements:Operators must provide the Division copies of agreements to compensate the owners of any <br /> significant, valuable, and permanent man-made structures and utilities within 200 feet of the affected land/permit <br /> boundary (this includes county roads, above ground and buried utilities, etc.).
