COLORADO Division of Reclamation, ' Mining and Safety Department of Natural Resources 1313 Sherman St. Room 215 Denver, CO 80203 July 20, 2020 Mr. Cliff Simpson C&H Aggregate LLC PO Box 211 Nunn CO 80648 RE: Lone Tree Pit,Permit M2010-047 Status of Incomplete Application for Transfer of Permit and Succession of Operators-SO01 Mr. Simpson, On July 10, 2020 the Division of Reclamation, Mining and Safety received the Application Form for Transfer of Mineral Permit and Succession of Operators from Miller Family Investments,LLC to C&H Aggregate LLC. of permit M2010-047. At this time,the Succession of Operators application as submitted has been deemed incomplete by the Division. The following item(s)have been submitted to the Division and are acceptable at this time: 1) Executed Performance Warranty Form 2) Succession of Operators Application fee of$144. The followin item(s)tem(s)are still required for your Succession of Operators application to be called complete: 1) Properly executed Application Form specifying the Designation of Review Timeline. This section, and the appropriate review timeline selection, needs to be properly executed by both the Current Permittee (Miller) and Prospective Successor(C&H Aggregate). 2) Demonstration of Legal Right to Enter the property for the purposes of mining and reclamation in accordance with Construction Materials Rules. To comply with this requirement, the Prospective Successor must demonstrate that he/she has obtained a legal right of entry from any and all surface and mineral rights owners in the affected lands, independent of the current Permittee. See Construction Materials Rules 6.3.7, 6.4.14, and 1 .6.2(l)(e)(i). This may be a copy of an access lease, deed, abstract of title, current tax receipt, or a signed and notarized statement by the property owners stating that the Prospective Successor has a legal right to enter. 3) Structure Agreements:Operators must provide the Division copies of agreements to compensate the owners of any significant, valuable, and permanent man-made structures and utilities within 200 feet of the affected land/permit boundary (this includes county roads, above ground and buried utilities, etc.).
