SOURCE OF LEGAL RIGHT TO ENTER As required by Colorado Mined Land Reclamation Board, in the Mineral Rules and Regulations for the Extraction of Construction Materials, Rule 6.3.7—Exhibit G—Source of Legal Right-to-Enter: Provide documentation of the legal right to enter to conduct mining and reclamation,for Owners of Record described in Rule 1.6.2(1)(e)(i). This may inchide a cop),of a lease, deed, abstract of title, a current tax receipt, or a signed statement by the Landowner(s)and acknowledged by a Notary Public stating that the Operates/Applicant has legal right to enter to conducting mining and reclamation. Garret Varra, as Vice-President of Varra Companies, Inc., being first duly sworn upon oath, deposes and says: 1. That the property and surface rights to the property shown on the Warranty Deed and known as Star Water Resource (DRMS Permit#M-1977-522) is owned one hundred percent in fee simple, by Varra Companies, Inc. 2. Everist, Incorporated, is empowered under an agreement with Varra Companies, Inc. to maintain and amend as needed the DRMS Permit#M-1977-522, as approved by the Colorado Mined Land Reclamation Board and its corresponding state agency, the Division of Reclamation, Mining and Safety (DRMS), as necessary to reclaim the permitted property. 3_ That L.G.
