("Hard Rock Act") and associated Rides (2 <br /> C'.C.R. 407--1) ("Hard Rock Rules") and the Land Reclamation Act for the Pxtrrction of <br /> Construction Materials (C.R.S. § 34-3Z5-10.1 et. seu.) ("Construction Materials Apt") and <br /> associated Rules (2 C.C.R. 407-4) ("Construction Materials Rules"). This Applicatioa Packet <br /> cannot be altered without the=consent rf the Board. <br /> Applicability <br /> 'I'his Transfer of a Mineral Permit anc Succession of Operators Application 'acket applies to <br /> mining operations where the current permitted mine operator(13ermittee") wishes to irmsfer the <br /> Reclamation Permit ("Permit'), alon3 with all associated reclamation responsibil=ties and <br /> liabilities, to a Successor Operator ("Successor"). This process is referred to as a Succession of <br /> Op rittors("'SO"). <br /> sxt� <br /> •�X t fd <br /> Filing Recluireit>ients for SO Al)plication <br /> An SO Application is not complete until the Division of Reclamation, M ning and Safety <br /> ("Division") has received each of the six items listed below. 1-he Board has authorized the <br /> Division to review SO Applications an] to issue approvals and denials based o-t its review. 'rhe <br /> Division will not review incomplete At plications. <br /> 1) Application Form: An Application Form is included in this Applicatior Packet. <br /> Please note that the Application Dorm must be fully completed, and must bear the <br /> original notarized signature o"an authorized representative of BOTH the Permittee and <br /> the Prospective Successor. <br /> 2) Application Fee: if an Application concerns a Hard Rock or Designated Mining <br /> Operation, then a filing fee of$I 15.00 must be submitted to the Division. See C.R.S. <br /> 34-32-127(2)(a)(1)(L). If an Application concerns a Construction Materials operation, <br /> then a filing fee of$144.00 riust be submitted to the Division. See 2.R.S. § 34-32.5- <br /> 125(1)(a)(X).
