We also acknowledge that you <br />leased the property to Gordon Smith who planted wheat in one or two fields at the north <br />end of the property for several years. <br />2. We apologize for the incorrect statement that there has not been any active farnvng on <br />the property for 15 years. We now understand that any sort of irrigation, farming, <br />ranching activity on land can be considered farming. According to the mining agency <br />rules, we needed to conduct a pre -mine land use study to establish what the pre -none <br />uses of the land are prior to mining. This was done for your property in 1999 and was <br />approved as part of the permit It does show that the majority of your land was irrigated <br />to some level at that tithe. It is not possible for any mining company to conduct extensive <br />historical studies of land use on properties. <br />3. WFC also acknowledges that you were able to irrigate all of the more level ground on <br />the south 3/4 of the property as well as the field by Tuttle Draw. We believe by aerial <br />• photographs that Gordon Snuth was able to irrigate this area with the same 24 shares of <br />CCC ditch water that still exists on the property. <br />We acknowledge all of the above items in your letter and we wish we could irrigate just , <br />as you did and not have to worry about any standards. It is important for you to know <br />that WFC has a State approved Irrigated Pasture reference area with approved ratio of <br />CCC water shares per acre, for all irrigated pasture lands to be reclaimed. In order for as <br />to get our reclamation passed by the State Regulatory Agent (DRMS), we must show <br />that the vegetation cover and vegetation production per acre on the reclaimed lands <br />closely matches the same levels of the reference area.
