11.8. Relationship of the Parties. The relationship of the parties hereto is contractual only, and shall <br /> not be interpreted as creating or implying any form of partnership, mining partnership,joint venture or <br /> similar business arrangement between the parties, and shall not result in either party being deemed to <br /> be an agent of the other. Lessee has acquired or may hereafter acquire interests in other lands and <br /> minerals in the vicinity of the Property or may conduct operations in the vicinity of the Property. <br /> Nothing contained in this Lease shall give Lessor any interest in such other lands, minerals or operations. <br /> 11.9. Recording. Lessor will not record a copy of this Lease in the real property records maintained <br /> by the Montrose County Clerk and Recorder. If requested by Lessee, the parties shall execute a <br /> memorandum or short form of this Lease, which document shall be in a form sufficient to constitute <br /> constructive notice to third parties but which shall not contain the amounts or rates of royalty, or other <br /> terms of this Lease which Lessee may elect not to disclose of record. The execution and recording of <br /> such memorandum or short form shall not limit, decrease or increase, or in any manner affect, any of <br /> the terms, rights, interests or obligations of the parties unoer this Lease. <br /> 11.14. Notices. All notices required or permitted to he riven hereunder shall be deemed nronerly <br /> given upon delivering the same to the party to be notified by prepaid certified mail, return receipt <br /> requested, addressed to the party to be notified at the address set forth above; provided, however,that <br /> all routine reports and all payments due hereunder may be delivered by ordinary first class United <br /> States mail,with postage prepaid and addressed to the Lessor.
