Well Monitoring Agreements and Commitments <br /> The signed agreements for well monitoring with the SPOs were complete August of 2013. One <br /> would think that the first well data would be included with the 2013 Annual report Due <br /> December 2013. There is not any well monitoring data and there are not any ground water <br /> trigger points included with the annual reports from the operator for 2013 thru 2019. The <br /> Operator stated that they had a computer hard drive problem and the data was lost. The <br /> Operator would still have the field data sheets and the shared data with the owner in the <br /> monthly reports. The Operator would have only lost one year of data because the data was to <br /> be included in each and every Annual Report. The Operator was cited by Peter Hayes for not <br /> monitoring the SPO wells in the 2015 Hernandez report. They were cited again in the 2017 in <br /> the Rocky Francis 2017 report for not reporting the well readings for the SPOs. There are well <br /> readings included in the 2017, 2018 and 2019 Loloff annual reports but the data is from the <br /> Derr Pit across the street. It appears that the DRMS did not even notice the incorrect data <br /> reporting. It appears that no one from the DRMS even reviews the Annual Reports and does <br /> not enforce the the requirements, agreements and commitments of the TR. <br /> How is it not a Violation when the Operator does not follow the rules and agreements with <br /> the DRMS? How is it not a violation when the Operator provides false information in the <br /> Annual report? <br /> Statute of Limitations <br /> Peter Hayes investigated a complaint for SPO Taylor in 2017. The Taylor well went dry in 2008 <br /> for the first time. Loloff did redrill the well in 2008 at their expense. The well went dry again in <br /> 2012. Peter Hayes completed a full investigation of the Taylor well 5 years after the well went <br /> dry. There was never any mention to Ms. Taylor about a Statute of Limitations of two years. <br /> Peter Hayes investigated the dry well for Stout from the first complaint. The original well was <br /> dry since 2016 as stated in the complaint. This is 4 years after the well went dry. The was no <br /> mention by Peter Hayes that there was a Statute of Limitation Since the well went dry in 2016. <br /> Peter Hayes Investigated the Stout well again. This time he did meet with Stout to go over the <br /> facts of the damages to the Stout Well. Again this wll has been dry for 4 years before the <br /> inspection. Again there was no Mention of any Statute of Limitations that would apply to this <br /> complaint. <br /> Received a letter from Director Means in Response to the Koehler Well Problems. The Koehler <br /> wells have lost water from 2012 to 2019, Irrigation well -9.1 feet, Domestic Well- 8.2 feet and <br /> the stock well -8.5 feet.
