July 8, 2020
RECEIVED
Colorado Division of Reclamation Mining and Safety
1311 Sherman Street Room 215 JUL 0
Denver, CO 80203 OWION OF RECLAMATION
BRINING&SAFETY
RE: "Protection of the Public" "Whistleblowers"
5
File No. Derr Pit M-2008-017 and Loloff Pit M-1985-112
Director Means, Director Brannon, Supervisor Cunningham:
With a very heavy heart I have to summarize my experiences with the DRMS. After reading the
Mission Statement for the DRMS I was very hopeful that there was a State Organization that
would regulate and enforce the rules for the Loloff Pit and the Derr Pit mining operations
including "Protection of the Public".
Copies of the quoted data can be sent to the DRMS file. Most if not all of the data is already
in the DRMS file. Please advise or at least tell me what form you would like me to use so the
Data is added to the correct file.
One way to find out about the Loloff Pit and the Derr Pit operations is to read the files online at
the DRMS. Right away I found several items that did not make any sense, data was missing or a
report just ended with items pending without any followup. So I started to make a list and I
sent my questions to the DRMS representative stated in the file. My experience is that the
questions typically do not get answered unless they are stated in a complaint.
The final result from the meeting on February 21st with Director Brannon and Director Means
was just a listening ear for an hour. Director Means stated that he would turn over my concerns
and information to 'his team' for evaluation. Data from the SPOs were sent to Director Means
after the meeting to explain and provide information that was not available during the meeting.
I waited 70 days without a response so I filed a complaint. Then and only then did I receive a
response.
This whole thing started for me by helping an old time friend Jim Koehler located across the
street to the north of the amendment to the Derr Pit. I was born and raised across the street
from the Koehler Farms. This was a very close knit community where everyone would help
another in a time of need. I was part of this community for 31 years and I have first hand
knowledge and experience with the ground water and native water.
My background is that I have 20 years of claim investigations within the insurance industry.
My degree is in Math and Science Teaching and an Associates degree in Insurance Claims.
