All
other conditions and requirements of Permit M1973-021 remain in full force and effect.
DBMS notes that this proposed haul road was evaluated for the potential to impact off-site areas and critical off site structures
in the event of a failure, as well as for the bonding increase necessary to reclaim the proposed roadway if mining activity
were to cease before the road was removed in the course of proposed activity. Site safety concerns, and immediate impact
to site features and operations due to a failure of this proposed haul road, were not evaluated as part of this review. On-site
safety requirements and enforcement fall under MSHA jurisdiction.
Because the revised reclamation liability amount exceeds the reclamation bond currently held, please submit additional bond
in the amount of$997,000.00 as detailed in the revision application. This additional bond will be held for reclamation of the
proposed haul road by the State if needed. This revision will not be final until the additional bond is approved by the Division.
If you have any questions, please contact me.
Sincerely,
Eric C.
