The New <br /> Horizon Mine operates under the Division of Reclamation,Mining and Safety(DRMS)Permit No. C- <br /> 1981-008. <br /> Rule 4.30.1(1) of the Regulations of the Colorado Mined Land Reclamation Board for Coal <br /> Mining require that any persons who cease surface and underground mining activities permanently shall <br /> close or backfill or otherwise permanently retain all affected areas. As the surface landowner for the <br /> meeting building listed in Table 2.05.3(3)-4, Tri-State on behalf of ERMR is requesting to retain the <br /> meeting building as a permanent structure.Post mining it will be returned to a residence as it was prior to <br /> mining occurring. <br /> I,Barry Ingold,as representative of Tri-State and the surface landowner ERMR,hereby request <br /> that the meeting building be retained as a permanent structure,and ERMR be released from the <br /> reclamation liability as required under Rule 3.02(4).
