As discussed, the attached BLM access agreement is the current binding agreement <br /> between Mesa County and the pit operator. Mesa County received the BLM parcels and <br /> continues to allow access under the same agreement. Therefore this operation currently has <br /> access. The BLM agreement is attached for reference. <br /> In reference to items 9, 10, and 11 on your Incomplete Application Letter, Mesa County and <br /> Mesa Agg LLC both recognize this access agreement expires in 2021. Currently, both parties <br /> are negotiating updated access agreements which include relocating the access to avoid <br /> conflicts with landfill and compost facility traffic. We anticipate this being complete within 1-2 <br /> months. Please contact Scott mays at 970.256.1508 if you have any questions. <br /> In reference to item 12, there are also no structures owned by other entities within 200' of the <br /> mining area.
