Three minor items as follows were <br />brought to the attention of the operator and were noted in DRMS's October 2019 inspection report. <br />o A patch of foxtail was identified above pond 12 in parcel 40. <br />o Wire enclosures were located during the inspection and should be removed <br />o A patch of Cirsiurn arvense (Canada thistle), was noted in the bond release <br />inspection report. <br />As these items impacted small areas and posed no significant impacts to the postmining land use <br />no action on the part of the operator was requested by DRMS. The operator, as the landowner, <br />agreed to address the items related to weeds and to the removal of all observed wire enclosures. <br />DRMS review of the bond release application and the supporting material identified several <br />adequacy review items regarding discrepancies in sampling time frames, acreage discrepancies <br />and other clarifications needed regarding vegetation sampling. SPL responded to the DRMS <br />adequacy concerns in a letter dated 18 March 2020 which included revised application pages. <br />DRMS found SPL's response adequately addressed the Division's concerns. SPL's response <br />withdrew all of the partial Phase II only acreage from consideration and made net minor changes <br />in partial combined Phase II/III bond release acreage and partial Phase III bond release acreage. <br />II CRITERIA AND SCHEDULE FOR BOND RELEASE <br />Phase I Bond Release <br />Rule 3.03.1(2)(a) states: <br />"Up to sixty percent of the applicable bond amount shall be released when the permittee <br />successfully completes backfilling, regrading, and drainage control in accordance with the <br />approved reclamation plan." <br />SPL's approved reclamation plan prepared in accordance with Rule 2.05.4 is contained in Volume <br />9, Tabs 19 through 21 of the permit application package (PAP).
