II and III and, a partial Phase III bond release for the Yoast Mine. This proposed decision will
release the applicant from Phase II and Phase III liability in a combined action for vegetation
establishment suitable for the designated land use of grazing and wildlife habitat over 39.4 acres
of previously Phase I released lands. Phase 11 bond release for 315acres approved in the SU
submittal is requested as Phase III release in this permitting action SL7 for a total Phase III release
request for all liability associated with 354.4 acres previously approved for Phase I and II bond
release.

The original performance bond for the SPL including revisions was $5,095,689.00. The current
performance bond comprises $5, 200,000. The most recent update of the reclamation liability for the
The Yoast Mine was completed in March 2017 during the Permit Renewal No. 4 (RN4) review
process. The current amount of surety held as per SL6 is $1,379,988.51.
For the partial Phase 11/III portion of this SL7 bond release, Rule 3.03.1(2)(c) states the remaining
portion of the bond amount shall be released when the permittee has successfully completed all
surface coal mining reclamation operations. Phase I release has been previously achieved on these
parcels, releasing 60% of the liability. $3,057,413.40 constitutes 60% of the original liability. The
partial Phase II/III portion of this SU bond release, is eligible for an additional 40% reduction. Per
Rule 3.03.1(2)(c), the Division may release up to $2,038,275.60 (40% of $5,095,689.00). The 39.4
acres requested for Phase II/III bond release make up approximately 4.63% of the 850.5 total
disturbed acres. The Division proposes releasing $94,372.16 (4.63% of $2,038,275.60), for Phase II
reclamation of 39.4 acres.
For the Phase III areas requested in the SL7, Phase I and II release have already been achieved,
leaving 15% of the entire amount remaining. The 315 acres requested for Phase III bond release
make up approximately 37.04% of the 850.5 total disturbed acres. 15% of $5,095,689.00 amounts to
$764,353.35. The division proposes releasing $283,040.05 (37.04% of $764,353.35) for this SL7
phase III bond release.
The total amount proposed for release in SL7 Phases II/III and III is $377,412.21, ($94,372.16 +
$283,040.05).
Division proposes to release $377,412.21 associated with the Phase II/III and Phase III portions of
this SL7 bond release. The remaining $1,002,576.30 ($1,379,988.51 - $377,412.21) is sufficient to
