Page 2 <br /> Adequacy Response#3 June 26, 2020 <br /> M-2020-007 <br /> At the current time, the top of the lateral berm is approximately 100 feet <br /> wide and will be revegetated except for the oil/gas well access road. Our <br /> research found that only the downstream portion of the lateral berm needs <br /> armoring to the same standards as any banks within 150 feet of the river. <br /> This will add approximately 1,800 feet of bank slope armoring in Phase 2 so <br /> the total becomes 3,785 liner feet. The plan for armoring as slope <br /> reclamation progresses in each Phase will remain unchanged. <br /> As previously stated, DRMS could review sound arguments to modify those requirements on a <br /> site-specific basis, but there will need to be sufficient hydrologic/engineering justification <br /> provided to do so. <br /> Please modify the mining and reclamation plans and maps as needed to depict the appropriate <br /> berm widths for the lateral berm, provide the appropriate designs, and show the locations for the <br /> necessary armoring on the Reclamation Plan Map. Costs for all pitside/berm protection will also <br /> need to be included in Exhibit L. <br /> The armoring of the south bank for Phase 2 has been added to the <br /> Reclamation Maps. It is not necessary to reflect the added cost since Phase <br /> 2 is not included in the working bond calculation show in Exhibit L <br /> EXHIBIT F - Reclamation Plan Map (Rule 6.4.6): <br /> Please show the locations of proposed pit armoring in Phases 1 and 2, as well as the lateral berm <br /> between phases, as described above. <br /> The Reclamation Maps have been revised to show the locations of proposed <br /> pit armoring. In Phases 1 and 2, armoring is shown along the west side of <br /> those phases. Along the lateral berm between Phases 1 and 2, the downslope <br /> armoring is shown on the south bank of Phase 2. <br /> EXHIBIT G -Water Information Rule 6.4.7 <br /> DRMS acknowledges the permittee's commitment to conducting the required baseline well <br /> testing for quality and yield prior to installing slurry walls, dewatering, or exposing groundwater <br /> within 200 feet of the well, if the well owner allows it. DRMS also accepts the proposed plan <br /> provided with the following clarification. If the permittee wishes to place a limit on the amount <br /> of time the well owner is given to respond before considering a lack of response a denial of <br /> access, the minimum time allowed for a response shall be no less than 30 days, and this <br /> limitation shall be clearly stated in the letter sent requesting access to conduct the well testing. <br /> The access letters should also be sent by certified mail or another trackable method so that <br /> delivery to the well owner can be verified. As previously stated, the McPeek well will need to be <br /> tested prior to the commencement of mining in Phase IA. <br />
