First, will or could continued subsidence from past <br />underground mining exacerbate geologic instability on cliff <br />faces and steep hillsides, particularly those above 1-70, a <br />major federal highway? Second, should subsidence from <br />underground mining be allowed to prevent or make <br />impossible future irrigation of the Fontanari lands with <br />Fontanari's decreed water rights, and, what remediation <br />might eliminate this problem? We believe that both of <br />these issues require an independent Federal review under <br />the governments statutory and oversight authority. <br />Items Requested by Fontanari <br />1. For a prompt inspection of the problem sites by Federal <br />and State Inspectors with appropriate qualifications <br />accompanied by representatives from Snowcap Coal, <br />Fontanari and any of his retained experts and counsel; <br />2. A determination as to whether any of the coal mining <br />related problems on-site could be addressed by funds <br />from the Abandoned Mines Fund, if eligibility was <br />determined through the DRMS process; <br />3. A determination as to whether any of the identified <br />problems could be addressed with emergency response <br />funds available for that purpose; <br />Page 07 <br />
