First, will or could continued subsidence from past
underground mining exacerbate geologic instability on cliff
faces and steep hillsides, particularly those above 1-70, a
major federal highway? Second, should subsidence from
underground mining be allowed to prevent or make
impossible future irrigation of the Fontanari lands with
Fontanari's decreed water rights, and, what remediation
might eliminate this problem? We believe that both of
these issues require an independent Federal review under
the governments statutory and oversight authority.
Items Requested by Fontanari
1. For a prompt inspection of the problem sites by Federal
and State Inspectors with appropriate qualifications
accompanied by representatives from Snowcap Coal,
Fontanari and any of his retained experts and counsel;
2. A determination as to whether any of the coal mining
related problems on-site could be addressed by funds
from the Abandoned Mines Fund, if eligibility was
determined through the DRMS process;
3. A determination as to whether any of the identified
problems could be addressed with emergency response
funds available for that purpose;
Page 07
