If not,please update this text to include <br /> discussion of the raptor nesting including any associated table as necessary. <br /> Response: A golden eagle did nest directly adjacent (west side) of Moffat County Road <br /> 51 just south of the intersection of the Collom Haul Road and Moffat County Road 51. <br /> Tri-State on behalf of Colowyo obtained a Golden Eagle Nest Take Permit (Permit No. <br /> MB63059C-0)with the U.S. Fish and Wildlife Service (USFWS), and the nest was <br /> mitigated in March of 2018. Monitoring of the nest mitigation occurred for two nesting <br /> seasons and the nest mitigation measure utilized were successful. On December 9, 2019, <br /> the final monitoring report was provided to the USWFS and Colowyo discontinued <br /> monitoring of the mitigation measures implemented as required by Permit No. <br /> MB63059C-0. Since there is not a nest to document as it was mitigated, and all golden <br /> eagle activity has ceased, no new information is being included in the permit. <br /> 3. Please review and update Threatened and Endangered Wildlife/Plant Species sections of <br /> the Colowyo's PAP as necessary. <br /> Response: The narrative and associated tables for Threatened and Endangered <br /> Wildlife/Plant Species has been updated as requested. It should be noted that all new <br /> information pertaining to Threatened and Endangered Wildlife/Plant Species has been <br /> consolidated into Volume 1. <br /> Rule 2.05.3 — Operations Plan <br /> 4. Please update the following tables as necessary. <br /> • Table 2.03-1 Affected Areas for Mining and Reclamation <br /> Response: Table 2.03-1 has been updated as requested. <br /> • Table 2.04.10-1 Vegetation Community Distribution on Areas to be Mined <br /> Response: Table 2.04.10-1 is being removed from the permit as Rule 2.04.10 does <br /> not required a permit to document disturbance areas by vegetation type. The citation <br /> to the table is also being removed in Section 2.04.10. <br /> • Table 2.04.9-7 Topsoil Mass Balance South Taylor Mine Area <br /> o Footer also mentions Map 28B which was removed from permit. <br /> Response: This table was previously removed from the permit and consolidated with <br /> Table 2.05-1.
