Environmental Assessment <br /> The ASLM must review the MPDD and decide whether to approve the mining plan modification, and if <br /> approved,what, if any, conditions may be needed. <br /> OSMRE Denver Field Division <br /> The Western Region of OSMRE is responsible for the oversight of State Regulatory Coal Programs. <br /> State of Colorado <br /> Colorado Division of Reclamation,Mining and Safety <br /> CDRMS is the regulatory authority for coal mines in Colorado that occur on state and private lands. As <br /> provided for under SMCRA,the State of Colorado developed its own regulatory program to permit coal <br /> mining with OSMRE acting in an oversight role. CDRMS manages its own coal regulatory program <br /> under SMCRA and the Colorado Surface Coal Mining Control Act of 1976. CDRMS has the authority <br /> and responsibility to: <br /> ■ Make decisions to approve SMCRA mining permits <br /> ■ Consult with federal land management agencies to determine if permit revisions will adversely <br /> affect Federal resources and are consistent with that agency's land use plans, federal laws, <br /> regulations and executive orders for which it is responsible, and <br /> ■ Regulate coal mining under regulations of the Colorado Mined Land Reclamation Board for Coal <br /> Mining. <br /> Coal leaseholders in Colorado must submit a PAP, or permit revision application,to the regulatory <br /> authority for proposed mining and reclamation operations. If the regulatory authority is the state,the state <br /> must notify OSMRE that the PAP is administratively complete and ready for OSMRE's review. The <br /> existing GCC CDRMS permit, C-1981-035,for the King 11 surface facilities is located entirely on state <br /> lands. In addition,the State Board of Land Commissioners Coal Mining Lease number is CO-3388 for the <br /> state land in Township 36 where GCC has located its surface facilities (refer to Map A-2). CDRMS <br /> reviews the PAP for the surface facilities to ensure that the application complies with the permitting <br /> requirements and that the coal mining operation would meet Colorado's performance standards. CDRMS <br /> is required to work with the coal company until the permit or permit revision can be approved. <br /> Department of Natural Resources <br /> CDNR's role is as a reviewing agency for the EA and to ensure conformance of the EA with the Colorado <br /> Surface Coal Mining Reclamation Act(34-33-101 et seq., Colorado Revised Statutes (CRS) 1973 as <br /> amended) (the Coal Act),the Regulations of the Colorado Mined Land Reclamation Board for Coal <br /> Mining (2 CR 407-2, 9/14/2005) (Colorado Coal Rules), and the policies and guidelines of the CDRMS' <br /> Coal Program. <br /> La Plata County <br /> La Plata County's role is as a reviewing agency for the EA and to ensure conformance of the EA with <br /> GCC's Conditional Class 11 Land Use Permit(Project 42012-0089). <br /> DOI-B LM-CO-S010-2011-0074-EA <br /> September 2017 <br /> -18- <br />
