In accordance with the 2011 DOI Policy on Consultation with Indian Tribes <br /> and the NHPA of 1966, this included those from the Colorado Office of Archaeology and Historic <br /> Preservation directory of tribes with historic ties to Colorado. The Hopi Tribe claims cultural affiliation <br /> with prehistoric cultural groups in southwestern Colorado. The Southern Ute Indian Tribe expressed <br /> concern for impacts on properties of religious and cultural importance to the tribe. Native American <br /> consultation is ongoing. <br /> 3.4.3.3 Environmental Effects <br /> The Dunn Ranch Area LBA and Mining Plan Modification Project is considered a federal undertaking <br /> subject to compliance with Section 106 of the NHPA of 1966. The NHPA(PL 89-665; 80 Stat. 915; 16 USC <br /> 470 et seq.), as amended, and its implementing regulations (36 CFR 60 and 800) require that federal <br /> agencies take into account the effects of their undertakings on important archaeological and historic sites <br /> (i.e. historic properties) in the area of potential affect (APE). In the terminology of NHPA, historic <br /> properties are those that are determined to be eligible to the National Register of Historic Places (NRHP). <br /> As such, OSMRE and BLM will assess whether the Project would have no effect, no adverse effect, or <br /> adverse effects to historic properties. Consultation with consulting parties including the State Historic <br /> Preservation Officer and Indian tribes including the UMU Tribe and other interested tribes is ongoing.The <br /> Dunn Ranch Area Coal Lease by Application COC-78825 and Mine Plan Modification EA 3-17 <br />
