PERMIT #: M-2008-017
INSPECTOR’S INITIALS: ECS
INSPECTION DATE: June 16, 2020

OBSERVATIONS

This was a monitoring inspection conducted by Eric Scott of DRMS of the Derr Pit (M2008-017) as a result of a
citizen complaint to DRMS. DRMS met on-site with Kelly Hodge to tour the site. On June 4, 2020 DRMS
received an electronically submitted complaint from adjacent property owner Ms. Snow alleging damage to a
fence located on the property line between the mine and her property, as well as historic damage to a water
well on her property.

The issue of the historic water well on her property was addressed in a letter dated June 5, 2020 to Ms. Snow
from DRMS. This inspection was conducted to determine if activity at the mine had resulted in damage to the
pre-existing fence between the properties. At the time of this inspection mining activity was taking place in
the “original” permit area, Phases 1-4 of the mine plan. Preparations were also being made for the installation
of the slurry wall for this area. No additional areas of the permit amended into the permit as AM01 has been
disturbed since the amendment was approved.

Mr. Hodge took DRMS to the fence which was the subject of the complaint. DRMS observed that the fence
was indeed falling over in several places along its length, both toward and away from the mining site. DRMS
also observed that the failure of this fence was not due to mine related activity (although there had been
recent activity in the area) but due to the fact that the wooden fence posts were severely dry-rotted, and had
rotted off at the ground surface resulting in the collapse of the fence in several areas (see attached photos).
Portions of this fence are visible as collapsed in G oogle Ea rth photos of the area taken as far back as 2016, so
this is not a recent occurrence.

As noted on the first page of this report, the permit boundary markers in the center and east sides of the
permit area were missing and will need to be replaced by the corrective action date. If the permit boundary is
delineated in an area by existing fences, those fences should be clearly marked as a permit boundary.

No other issues were noted during this inspection.

Inspection Contact Address
Kelly Hodge
Broken Arrow Investments LLC
699 N.
