C 0 L0 R ,A D0 <br /> Division of Reclamation, <br /> TrA '%UiV Mining and Safety <br /> Department of Natural Resources <br /> June 5,2020 <br /> Jeanette Snow <br /> 503 Cherry Ave. <br /> Greeley,CO 89631 <br /> RE: Receipt of Citizen Complaints;Derr Pit(M-2008-017)and Loloff Mine(M-1985-112) <br /> Dear Ms. Snow, <br /> The Division of Reclamation, Mining and Safety (Division) is in receipt of the citizen complaints for the <br /> above referenced mines. The Division received the first complaint on May 22, 2020 and the other two <br /> complaints were received on June 4, 2020. Copies of the citizen complaints have been placed in the public <br /> files for each of the mines and have been forwarded to the respective Operators. <br /> The complaints stated the domestic well on your property initially went dry in 2014 and permanently dried up <br /> in 2016. The complaints also note this occurred when dewatering was occurring at the Loloff Mine. Impacts <br /> to domestic wells which are caused by a mining operation are within the jurisdiction of the Division to <br /> investigate, as all mining operations are required to minimize impacts to the prevailing hydrologic balance. <br /> However,the Division is limited in its ability to pursue enforcement actions pursuant to the two year statutory <br /> limitation set forth in C.R.S. 13-8-102(1). As such, the Division is unable to perform an investigation into <br /> groundwater impacts that occurred 4 years ago. The Loloff Mine is in the final stages of reclamation and <br /> dewatering is no longer occurring. Construction of the reservoir was completed in 2018 and the Division of <br /> Water Resources approved the facility on April 26,2019. <br /> The complaints stated the fence on the west and north sides of your property have been damaged. <br /> Photographs were provided which show stockpiles of material located immediately adjacent to your fence. <br /> You confirmed during our phone conversation on June 5, 2020, the Derr Pit was the cause of the damage to <br /> your fence. Impacts to structures which are caused by a mining operation are within the jurisdiction of the <br /> Division to investigate, as all mining operations are required to protect permanent man-made structures <br /> within 200 ft. of the mine boundary from damage. The Division will schedule an inspection of the Derr Pit to <br /> assess the damage to your fence and to ensure the Operator is in compliance with the terms of their <br /> Reclamation Permit.
