Peter Hayes RECEIVED
Division of Reclamation, Mining and Safety
MAY 2 8 2020
1313 Sherman St, Suite 210
Denver, CO 80203 I IONOFRECLAMATlN
MINING AND SAFETY
Dear Peter,
RE: Albert Frei and Sons, Inc. - Walstrum Mine f/J
M-1983-033 Partial release request
After we talked about the status of Stages X & Z the other day and I received
your E-mail on the some topic, I reviewed my file and talked to Al Frei, Jr. about the
sticking point on this release request. Your timeline and status are close but my file had
more details and Al had some documents that explain how we got to this point. We feel
you should consider the information included and hope that with it, you will agree that it
would be appropriate to just release Stage X and Stage Z from the permit.
We feel the documentation will show that the intended end uses and County Zoning
have not changed since 2002 to an extent that it would require an Amendment. With
Stages X and Y being out of the Planned Development (P.D.) for the quarry at the County
level, their release from the Reclamation Permit makes perfect sense as we progress into
the next amendment so that there will be no confusion between the Local Government
permit boundary and the Reclamation Permit boundary as we move through the process.
The attached Quarry notes document has my research notes on the timeline and
discussion for what has happened since 1985. The Resolution NO 06-128 file is the
Resolution showing the rezoning of the area covering both stages. It has a comprehensive
list of the changes that have taken place to the P.D. and the ER Case NO EX2001-0001
document is the division of the parcels that allowed for selling Stage X to Clear Creek
County. I found no indication that either area was listed, after 2002, as rangeland or
water storage.
