4 <br />particulate emissions (dust) from the pit and associated mining <br />equipment. <br /> <br /> 3. Traffic <br /> <br />a. BAI will comply with all applicable traffic requirements contained <br />in amended USR Permit No. 2MJUSR19-08-1660, State laws, and <br />local ordinances. BAI will ensure that drivers servicing the Derr Pit <br />utilize only designated haul routes. <br /> <br />b. Loloff will comply with all applicable traffic requirements <br />contained in USR Permit No. AM USR-690, State laws, and local <br />ordinances. Loloff will ensure that drivers servicing the Loloff Pit <br />utilize only designated haul routes. <br /> <br /> 4. Water Well <br /> <br />a. BAI shall perform monthly monitoring on the Murata well that <br />Murata continues to operate after execution of this Agreement, <br />provided Murata grants access to do so in accordance with <br />Paragraph III.B.3. hereof. Such monitoring shall consist of <br />measuring the static water level in the well. BAI shall send the <br />monitoring results to Murata each month by certified mail. <br /> <br />b. If monthly monitoring shows that the water level in the existing <br />domestic well on the Property gets to a level where pumping is no <br />longer possible, BAI shall, within ten days of such water level <br />measurement and at its sole expense, hire Quality Well and Pump of <br />La Salle, Colorado to check the pump in the affected well and repair <br />to allow continued production. During the time the well is out of <br />service BAI would pay the North Weld Water District water bill and <br />assist with plumbing changes to make the potable water available <br />for the domestic well irrigation. <br /> <br /> B. Murata <br /> <br />1. Within seven days of the execution of this Agreement, Murata shall provide <br />the Weld County Board of County Commissioners a letter withdrawing her <br />objections to BAI’s efforts to amend the USR Permit, 2MJUSR19-08-1660, <br />to allow mining in the Amendment Area. Murata’s withdrawal letter shall <br />be substantively similar to the draft letter contained in Exhibit B to this <br />Agreement. <br /> <br />2. Murata shall fully consent to and support BAI’s efforts to gain <br />governmental approval to expand mining operations into the Amendment <br />Area. Murata shall not, to a Government Authority or otherwise, protest,
