Austin & Betsy Clennin <br /> 10826 Clennin Road <br /> Rye, CO 81069 <br /> (719) 251-2996 <br /> April 1, 2020 <br /> Colorado State Land Board <br /> 1127 Sherman Street, Suite 300 <br /> Denver, CO 80203 <br /> RE: Structure Agreement <br /> Becker Pit <br /> To whom it may concern; <br /> Austin & Betsy Clennin, has filing for an application for Colorado Mined Land Reclamation (MLRB) <br /> Limited Impact 110 permit(M-2020-022) to extract sand and gravel materials from the Becker Pit, <br /> located in or near parts of the SW'/4SW'/4, Section 10, parts of the NWIANW'/4, Section 15, Section 15, <br /> Township 25 South, Range 67 West of the Sixth Principal Meridian, Huerfano County, Colorado. <br /> This letter, area map and attached Structure Agreement is being sent to you as part of the permitting <br /> process to address a MLRB rule that requires the operator/permittee to pursue an agreement with owners <br /> of any structures within 200 feet of the permit area, in which the operator agrees to reimburse the <br /> structure owner for any damage done to their structure as a result of the mining operation. In lieu of <br /> obtaining an agreement, the operator can provide the state with a Geotechnical study that demonstrates <br /> that any structures within 200 feet of the permit area shall not be damaged by activities occurring at the <br /> mining operation. If we do not receive this agreement from you in a reasonable time period, we will <br /> preform the study. <br /> We are delivering this agreement to you as required by law, but also because we wanted to inform you of <br /> all the aspects of the MLRB rules and also be able to provide you assurances that should something occur <br /> that we do not foresee, Austin& Betsy Clennin will repair or replace the damaged structure. <br /> Please return this agreement, signed and notarized, within 30 days of receiving it, if possible. Enclosed is <br /> a stamped, addressed envelope so you can return the executed agreement to us. We have enclosed a <br /> second copy of the agreement for your files.
