EVERIST, INC. can enter, <br /> mine and reclaim the subject area. Copy attached for ease of reference. <br /> EXHIBIT O - Owner(s) of Record of Affected Land (Surface Area) <br /> and Owners of Substance to be Mined (Rule 6 .4 .15) : - Adjacent <br /> surface owners Darrell McCrumb Trust and Carol Chavez Living <br /> Trust are shown on map (far SE corner) , but not listed in text on <br /> map, or in Exhibit O. Please revise as needed. (For what it' s <br /> worth, I really appreciate having all these surface/ROW owners <br /> listed in one location) <br /> Thank you for catching this. I revised Exhibit O and any other lists on the maps to add their <br /> contact information. We also found they did not get the Adjoining owner letter so a version <br /> was mailed to them on Friday April 17, 2020 that extended the public comment for them <br /> until April 30, 2020 in case they had any comments or objections. We ask that if you <br /> receive any objection correspondence from them it be admitted to the file and treated as a <br /> timely comment letter.. <br /> EXHIBIT S - Permanent Man-Made Structures (Rule 6.4 .19) : DRMS <br /> notes the provided evidence (certified letter receipts to struc- <br /> ture owners) that a notarized agreement between the structure <br /> owners and the applicant was pursued. <br /> To date L.G. Everist, Inc. received 4 signed Structure Agreements back from the 24 mailed. <br /> Copies are attached for the file and should any more be received they will be supplied for <br /> the file. <br /> If an agreement is unable to be reached a geotechnical assessment <br /> may be provided to demonstrate that the structures shall not be <br /> damaged. You must provide information sufficient to demonstrate <br /> that the stability of any structures located within two hundred <br /> (200) feet of the operation or affected land will not be ad- <br /> versely affected. <br /> The geotechnical report required (and also referred to in the <br /> sample letter provided) was not included with the application <br /> submittal package . Please provide . <br />
