Dues Fees and Assessments. All water Springs Utilities leases under this Agreement shall be for <br /> one time use only and for Lessee's use exclusively. In addition, Lessee shall not use <br /> Leased Water, directly or Indirectly, to support the cultivation or distribution of marijuana. <br /> Springs Utilities shall have the right to terminate this Lease and cease deliveries of water <br /> hereunder if it determines that the Leased Water Is being utilized for the cultivation or <br /> distribution of marijuana. <br /> 8. Reserved Riehts,, Springs Utilities retains dominion and control and all rights to return <br /> flows generated from reusable Leased Water delivered to Lessee. Springs Utilities <br /> reserves the right not to lease water under this Agreement R in its sole judgment such <br /> water is required to supply the needs of Springs Utilities'customers.Springs utilities is not <br /> obligated to extend or renew this contract or deliver Leased Hater after the expiration of <br /> the Delivery Time Period. <br /> . Rules and Regulations. If applicable, Lessee shall be responsible to comply with all <br /> Rules and Regulations in effect of the canal or storage company for the delivery and use <br /> of the Leased Water, and shall bear all delivery or transit losses assessed for the delivery <br /> and storage of the Leased Water. <br /> 19.Disclaimer of Warranties. Springs Utilities makes no warranty of any kind as to the <br /> tinning, availability, quality, or suitability of the Available Water or Leased hater delivered <br /> hereunder to Lessee for any particular use; the Lessee assumes all such risks. <br /> 11.Approvals. Lessee Is responsible for obtaining all approvals of the State Engineer or <br /> Division 2 Engineer,as well as all other necessary approvals required for the delivery and <br /> use of Leased hater. <br /> 12.Assignment. There shall be no assignment of the rights or obligations contained in this <br /> Agreement by either party without the prior written consent by the other party, and any <br /> such assignment shall be null and void. Nothing herein shall be construed to grove any <br /> rights or benefits hereunder to anyone other than Springs Utilities and Losses. <br />
