1-/\L\.V I IVO II S.VI I <br /> possession of the Leased Premises, Lessee shall be guilty of an unlawful detainer under the statutes in <br /> such case made and provided, and shall be subject to all the conditions and provisions thereof and to <br /> eviction and removal, forcibly or otherwise, with or without process of law, as above provided. <br /> d) Interest and Processing Fees; Penalties. Interest and processing fees in the amount of one point five <br /> percent (1.5%) per month or, in the alternative and at Lessor's sole discretion, at a rate as provided in <br /> Lessor's published fee schedules at the time the interest accrues shall be imposed for late payments and <br /> improper or partial payments. In addition, the State Land Board may charge penalties as provided in <br /> the State Land Board's published fee schedules, as they may be amended from time to time. Such <br /> interest, processing fees, and penalties (if any) shall accrue from the dates such amounts accrued to <br /> the Lessor until paid by the Lessee. <br /> e) Cumulative Rights. The rights and remedies reserved to the Lessor, including those not specifically <br /> described, shall be cumulative, and the Lessor may pursue any or all of such rights and remedies, at the <br /> same time or separately. <br /> 36. INSURANCE -- The Lessee at its sole cost and expense, shall during the entire Term of this Lease <br /> procure, pay for and keep in full force and affect the following types of insurance: <br /> a) Property Insurance. A policy of property insurance covering all insurable improvements located on <br /> the Leased Premises (except for land, foundation, excavation, and other matters normally excluded <br /> from coverage), in an amount not less than necessary to cover the replacement cost. Such <br /> insurance shall afford protection against at least the following: (1) loss or damage from fire and <br /> other perils normally covered by the standard extended coverage endorsement; and (2) such risks <br /> as shall customarily be covered with respect to projects similar in construction, location and use, <br /> including all perils normally covered by the standard "all risk"endorsement where such is available. <br /> b) Liability Insurance. A commercial general liability insurance covering the improvements and the <br /> Leased Premises insuring the Lessee in an amount not less than Two Million Dollars ($2,000,000), <br /> and covering bodily injury, including death to persons, personal injury, and property damage <br /> liability. Such coverage shall include, without limitation, legal liability of the insured for property <br /> damage, bodily injuries and deaths of persons in connection with the operation, maintenance or use <br /> of the Leased Premises. Coverage shall also include all reasonable legal expenses and other <br /> reasonable costs incurred by the Lessor related to any claim under this Lease. <br /> c) Workers Compensation. Workers' Compensation Insurance as required by State statute, and <br /> Employer's Liability Insurance covering all of Lessee or subcontractor employees acting within <br /> the course and scope of their employment. <br /> d) Other Risks. In addition, the Lessee shall obtain insurance against such other risks of a similar <br /> or dissimilar nature as the Lessor shall deem appropriate. <br /> e) General Provisions of Insurance Policies: <br /> 1. All policies of insurance carried by the Lessee shall name the Lessee as insured and shall include <br /> the Lessor as an additional insured. <br /> 2. The policy shall contain a provision that it cannot be cancelled until insurers have provided at <br /> least thirty (30) days prior written notice thereof to the Lessee and Lessee shall forward such <br /> notice to the Lessor in accordance with Paragraph 22 within seven (7) days of Lessee's receipt of <br /> such notice. <br /> 3. Notwithstanding anything to the contrary contained herein, the Lessee's obligation to carry <br /> insurance as provided herein may be brought within the coverage of a "blanket" policy or policies <br /> Page 15 of 18 <br />
