I VI• '..VI I <br /> to that land wilt not adversely affect the success of reclamation, the mined land will be <br /> backfilled, graded, top soiled, and revegetated. <br /> d) Control of noxious weeds shall be implemented on all land disturbed as a consequence of the <br /> mining operation. <br /> Variations from the Reclamation Plan as originally submitted to the Lessor for approval may be <br /> granted only with the written approval of Lessor. <br /> 19. LESSOR'S APPROVAL -- Whenever approval by Lessor is required or contemplated by Lessee, approval <br /> must be in writing and shall be optional and shall be within the sole and absolute discretion of Lessor. <br /> Lessor will make best efforts to provide a notice of approval or disapproval within thirty (30) days of <br /> the receipt of a written request for approval from the Lessee. <br /> 20. OTHER STATE AGENCIES -- Lessee shall notify and give Lessor full rights to access to any documents <br /> filed with any other federal, state, or local government entity which relates in any way to this Lease or <br /> the Leased Premises. <br /> 21. INSPECTION -- During all proper hours and at all times during this Lease, Lessor or Lessor's duly <br /> authorized agent, representative or consultant is authorized to check assays and scales as to their <br /> accuracy, to go through or on any part or all of the Leased Premises to examine, inspect, survey and <br /> take measurements of the same and to take samples of any kind and to examine and make extracts <br /> from or copies of all books and weight sheets and records which show in any way the ore output, ore <br /> values, payments and royalties from and of the Leased Premises. All conveniences necessary for such <br /> inspection, survey, or examination shall be furnished to Lessor. Lessor may require Lessee to provide <br /> all instruments and documents of any kind and nature whatever which affect Lessor's interests. Any <br /> agent, representative or consultant of the Lessor must follow standard safety practices while on the <br /> Leased Premises. Examples of standard safety practices may include driving only on marked roads, <br /> avoiding equipment that is in operation, making every effort to remain visible, wearing personal <br /> protective equipment such as high visibility clothing, protective eyewear and protective footwear. <br /> Lessor will make best efforts to provide a minimum of twenty four (24) hours advance notice prior to <br /> conducting an inspection or consultant activities. Lessor's agents, representatives or consultants will <br /> follow all check-in and check-out procedures that are established by the Lessee. Lessor shall not be <br /> responsible for injury or damage caused by the gross negligence of any Lessor agent, representative or <br /> consultant during inspection of the Leased Premises. <br /> 22. NOTICES -- Any notice, demand, request, designation, consent, approval or other document or <br /> instrument required under the provisions of this Lease shall be in writing, shall be deemed to have <br /> been duly served on the day of receipt or rejection by a Party and shall be sent by registered or <br /> certified United States mail, postage prepaid, return receipt requested, or by a nationally recognized <br /> overnight courier service that provides written evidence of delivery, as addressed to the Parties. The <br /> Parties may change the place for serving such papers on it, or provide for the delivery of not more than <br /> two (2) additional copies, by giving the other Party at least thirty (30) days prior written notice to such <br /> effect.
