Therefore, exposure <br /> of ground water must not occur during or after mining operations. <br /> According to the applicant, potable drinking water will be purchased commercially and brought to the site. <br /> The applicant will need to document that the water was obtained from a legal source that allows such use. <br /> Additionally, irrigation water will be supplied by the landowner via water right pursuant to the decree <br /> approved by the Division 5 Water Court in case no. 07CW16, for reclamation needs. <br /> The applicant intends to permit a well onsite for its industrial uses including crushing and screening plant <br /> operations,dust control,and wash plant operations. Per the application,the operator will contract with West <br /> Divide Water Conservancy District for augmentation water and apply for a substitute water supply plan <br /> (SWSP)with this office. <br /> Prior to initiation of the proposed uses of ground water, the applicant will need to obtain either a gravel pit <br /> or other type of well permit, as applicable. When applying for a well permit, the applicant must conduct a <br /> field inspection of the site and document the locations of all wells within 600 feet of the permit area. The <br /> applicant must then obtain a waiver of objection from all well owners with wells within 600 feet of the permit <br /> area.The applicant must then obtain a waiver of objection from all well owners within 600 feet of the permit <br /> area or request a hearing before the State Engineer. <br /> A valid well permit must be obtained for any exposure of ground water occurring during or after mining <br /> operations and for any ground water uses. This location is considered overappropriated and augmentation <br /> will be required if groundwater is exposed. <br /> If storm water is not diverted or captured in priority, Colorado Water Law requires it to be released, or <br /> replacement for evaporation will be required of the impounder/operator/owner of the gravel pit. The State <br /> Engineer's current policy requires that all impounded water be released to the stream system within a <br /> maximum of 72 hours after impoundment.
