determined total exposed surface acres for those sites are set forth in Paragraph 14 above.
18.2 Accounting. Accounting shall be on the accounting forms attached hereto as
Exhibit F, or on a similar form, as approved by the Division Engineer. LRM shall send copies of
its monthly accounting records to the Division Engineer on a monthly basis, or more frequently
as required by the Water Commissioner or the Division Engineer, and to the parties to this
proceeding upon their request. The accounting forms are not decreed herein and may be changed
from time to time so long as the information required by this decree is included in the forms and
such changes are approved or required by the Division Engineer or Water Commissioner without
need for Water Court approval. The accounting shall be reported monthly and include the
information described in this paragraph. On a monthly basis, LRM shall record the following:
(1) the total amount of net evaporative loss; (2) Amount of concrete production in cubic yards;
(3) Amount of washed mined product in tons; and (4) Amount of water used for dust
suppression. Based upon the monthly amounts described in (1) to (4) above, LRM shall
calculate the monthly lagged depletion using the aquifer parameters and method described in
Paragraph 15. On a daily basis, LRM shall calculate and record its stream depletion based upon
the monthly' depletion divided by the number of days in the month. On a daily basis, LRM shall
measure and record the following: (5) Releases of replacement water from storage from
Loveland Ready Mix Ponds 1 and 2 to the Big Thompson River; (6) Reservoir water balance
including inflows, outflows, change of storage, evaporation, and releases of out of priority
precipitation; (7) diversions under the Barnes Ditch contract inches and the water rights for
Loveland Ready Mix Ponds 1 and 2; (8)direct Barnes Ditch augmentation deliveries to the Big
Thompson River, which shall be accounted for daily and reported monthly; and (9) historical
Barnes Ditch return flow obligations. The accounting form will record the daily call and show
whether the total daily depletion requires replacement or not, based upon the call. Using all of
the data described herein, the accounting will then show on a daily basis, the total replacement
requirement and total replacement supply released to the stream. While mining operations at the
Larimer Pits are ongoing, the accounting shall also include the annual total exposed surface area
at the Larimer Pits determined pursuant to Paragraph 15.2.
18.3 LRM shall install and maintain,at its expense, necessary meters, gauges or other
measuring devices required by the Water Commissioner or Division Engineer and will report at
reasonable times to the Division Engineer or Water Commissioner the readings of such meters,
gauges, or other measuring devices pursuant to C.R.S. § 37-92-502(5)(a).
18.4 During the months of November through March, LRM shall replace out of
priority depletions within the month of occurrence of such depletions, but the Division Engineer
or Water Commissioner may allow or require more frequent releases and replacement, or
aggregated releases and replacement within the month that such depletions occur. During the
months of April through October, LRM shall replace out of priority depletions on a daily basis
when there is a valid call for water from a downstream senior water right, but the Division
Engineer or Water Commissioner may allow or require aggregated releases and replacement of
not more than 6 acre-feet of aggregated out of priority depletions within the month that such
depletions occur.
18.5 The maximum annual amount of consumptive use from mining, production and
11 of 14
