The 120 inches are contract rights, the <br /> nature, extent and uses of which are defined in the decree in Case No. 00CW 143. entered <br /> March 24, 2008. The summary below is not intended to alter any provision of that <br /> decree. <br /> 16.1.2 Priorities: Loveland Ready Mix's Barnes Ditch contract inches represent <br /> the right to use portions of the following priorities, decreed May 28, 1883. in Boulder <br /> County District Court: <br /> Priority 6 October 20, 1865 18.56 cfs <br /> Priority 13 June 1, 1867 12.06 cfs <br /> Priority 21 June 23, 1873 19.93 cfs <br /> 16.1.3 Amount available: Subject to the terms and conditions decreed in Case <br /> No. 00CW 143, Loveland Ready Mix is entitled to a maximum of 2,444 acre feet of <br /> consumptive use of its Barnes Ditch contract inches over any 10 consecutive years. <br /> 16.1.4 Point of diversion: the headgate of the Barnes Ditch, located in the NW '4 <br /> NE 1/4 Section 17, T5N, R69W, 6th P.M., Larimer County on the left bank of the Big <br /> Thompson River. <br /> 16.1.5 Places of storage: Loveland Ready Mix Ponds 1 and 2, located on the <br /> Larimer Pits site. Ponds 1 and 2 are lined reservoirs created by gravel mining, located in <br /> the NW 1/4 and the W 'A NE 1/4, Section 16, T5N, R69W, 6th P.M., Larimer County, south <br /> of the Barnes Ditch and north of the Big Thompson River, more particularly described in <br /> the decree in Case No. 98CW431. <br /> 16.1.6 Decreed limits on use: The uses. amounts of use, and places of use of <br /> Loveland Ready Mix's Barnes Ditch contract inches are restricted by the decree in Case <br /> No. 00CW 143. The uses described in this decree are authorized by and consistent with <br /> those restrictions. <br /> 16.1.7 Point of delivery to the Big Thompson River: The outlet from Loveland <br /> Ready Mix Ponds 1 and 2 is located on the Larimer Pits site approximately 2,100 feet <br /> South and 400 feet East of the NW corner of the NE 1/4 of Section 16, T5N, R69W, 6th <br /> P.M. The location of the outlet may be changed with approval of the Division Engineer, <br /> as long as water is released to the Big Thompson River upstream of the headgate of the <br /> Greeley Loveland Canal. <br /> 16.1.8 Source: Big Thompson River. <br /> 16.2 Loveland Ready Mix Ponds 1 and 2: <br /> 9 of 14 <br />
